The state Superior Court has issued a ruling with the potential to clear a legal logjam and deliver at least $1.78 million and, possibly, more than $5 million in damages to the survivors of two women who were killed in a drunken-driving crash on St. Patrick's Day in 2006.
A lawsuit filed in 2007 by the survivors of crash victims Megan Watson and Heidi Spicer stalled in Erie County Court after the insurance company for the former Peccadillo's nightclub refused to defend Peccadillo's against claims that the tavern was liable for the women's deaths. The driver of the car that struck Watson's and Spicer's vehicle, Jacob Latta, and his passenger, Matthew Maisner, were celebrating St. Patrick's Day at Peccadillo's, and were tossed out by bouncers after they fought with another person inside the bar.
The insurer Penn-America Insurance Co. maintained its policy excluded coverage for liquor liability.
In a nearly unanimous ruling, a nine-judge panel of the Superior Court has ruled that Penn-America did have the duty to defend Peccadillo's.
